Terms and Conditions

1. Contract Terms

1.1. We agree to provide our services to you under the following terms and conditions. These terms form a contract. Any other terms found in different documents are not included unless their inclusion is specifically agreed upon in writing.
1.2. In these terms and conditions, “services” refers to the rental of the chosen package theme, including the vehicles and equipment agreed upon at the time of booking, for the specified time and date.
1.3. The individual making the booking must be 18 years of age or older, as a booking represents a legally binding contract between you and Little Driver NZ Ltd.

2. Payment

2.1. In addition to the package price, a NZD 100.00 damage and booking deposit is required, which will be refunded if your event occurs as planned and no damage or loss has been incurred during the rental of our vehicles or equipment. Payment for the services is required in advance of booking. The remaining balance must be settled 48 hours before the rental date. Payments can be made via online bank transfer or cash. The damage deposit will be refunded to your account via online bank transfer within 48 hours after your event, provided that no damage or loss has occurred.

3. Your obligations. You agree that you will:

3.1. No food, drink, or water is to be used on or near the cars and equipment.
3.2. If your event is held outdoors, it is your responsibility as the hirer to consider the weather when making a booking. If you do not arrange any alternative provisions for adverse weather, we are not liable to refund the cost of your event, but will hold this amount in credit for you to reschedule the event.
3.3. The vehicles will be delivered fully charged and should last an average of 2 hours. If the battery runs out, please do not attempt to charge them yourself. Our team will ensure that the cars remain drivable throughout the duration of your event.
3.4. Children must be supervised by a responsible adult at all times, and children must be seated in the vehicles while using them.
3.5. Individuals over the age of 8 are not permitted to use the vehicles.

4. Cancellation

4.1. If you cancel the event before the scheduled date, the NZD100.00 Booking Deposit will be kept, and any additional payments made will be refunded. However, if you cancel within 48hours of the event, all payments will be retained. 
4.2. Little Driver NZ Ltd reserves the right to modify or cancel any event booking on the day of the event due to weather conditions or other factors beyond our control. In case of unforeseen circumstances, such as adverse weather, Little Driver NZ will make an effort to accommodate these circumstances and proceed with the hire, but this may not always be feasible. If the event is cancelled due to bad weather and no alternative arrangements have been made by the hirer, the deposit will be retained, and the event can be rescheduled for a later date. If the event is not rescheduled, the booking deposit will be kept, and the remainder of any payments will be refunded. No further compensation will be offered. 
4.3. Little Driver NZ Ltd reserves the right to refuse delivery of a party if the venue or access to the venue is considered unsuitable or unsafe for staff upon arrival. No refund will be provided in this case. The venue and access requirements are detailed and accepted by the customer at the time of booking.

5. Termination

5.1 Either party may terminate this agreement immediately by providing written notice to the other party if a material breach of this agreement occurs. If the breach can be remedied, the party in breach must correct it within 7 days of receiving written notice that includes full details of the breach and a request for remediation.

6. Liability

6.1. We commit to providing the services with reasonable skill and care. We accept liability for our own negligence only to the extent outlined in this clause.
6.2. Nothing in this agreement should be interpreted as limiting or excluding our liability for death or personal injury caused by our negligence or for fraud, or as affecting the statutory rights of any individual acting as a consumer to the extent that such rights cannot be waived.
6.3. To clarify, neither party shall be liable to the other for any indirect or consequential loss of any kind and regardless of the cause.
6.4. We do not assume any implied obligation, duty, or liability in the contract beyond those that are explicitly stated in this agreement.

7. Force Majeure

7.1 We shall not be held responsible for any violation of this agreement resulting from circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, fire, lightning, explosion, war, flooding, civil unrest, industrial disputes (regardless of whether they involve our employees), failures or interruptions in electricity supply, extreme weather conditions, or actions taken by local or central government authorities or other entities.

8. General

8.1. No waiver or amendment to these terms shall be effective unless it is in writing and signed by both parties.
8.2. A person who is not a party to these terms may not enforce any of them under the Contracts 
8.3. Little Driver NZ Ltd provides cars and equipment on the condition that parental supervision is required at all times, with parents being responsible for the safety of the children during the hire period.
8.4. At the beginning of the party, the lead hirer receives comprehensive instructions on operating the vehicles along with a detailed safety briefing.
